Condo Association Insurance in South Florida
Condo association boards in Boca Raton, Miami-Dade, Broward, and Palm Beach carry a fiduciary duty to protect the building and the unit owners behind it. Between Florida's post-Surfside safety laws, a hard property market, and rising reconstruction costs, the association's master insurance program has never mattered more - or been harder to place well.
What the master policy has to do
A condo association's program typically starts with a master property policy covering the building and common elements, general liability for common areas, directors and officers (D&O) liability for board decisions, crime/fidelity coverage, and often an umbrella. How the master policy defines its responsibility - bare walls, single entity, or all-in - determines where the association's obligation ends and the unit owner's HO-6 begins.
SB 4-D changed the financial picture
Florida's SB 4-D requires milestone inspections and structural integrity reserve studies (SIRS) for qualifying buildings, and it sharply limits an association's ability to waive or underfund reserves for structural components. Boards are discovering that insurance, reserves, and inspection findings now interact: a building with unresolved findings can face tougher underwriting and higher premiums.
The loss assessment gap owners never see coming
When a covered loss exceeds the master policy's limits - or a large deductible comes due - associations can assess unit owners for the difference. That is why the master program and the unit owners' HO-6 loss assessment coverage need to be reviewed together, not in isolation.
